How Do I Know I Have a Case?
In a free case evaluation, our lawyers will be able to learn more about your unique circumstances. There are several factors that need to be determined to see if you have grounds to take legal action. Some questions you should be prepared to answer include:
- Why were you prescribed this medication versus other asthma drugs?
- How long have you been taking the medication and have you since stopped?
- How many times a day do you or did you take it?
- Have you since suffered neurological side effects, such as nightmares, depression, aggressive behavior and/or suicidal thoughts and actions?
- Have you sought mental health treatment or been hospitalized due to serious adverse reactions from taking the medication (hallucinations, problems with memory or attention, tremors or shaking, or worsening asthma symptoms)?
- In what ways has taking this drug impacted your daily life and relationships with loved ones?
- Have you suffered other physical, financial or emotional setbacks?
Taking legal action against drug manufacturers is no easy feat. These cases are complex and challenging, especially without an experienced lawyer on your side. If you have a valid case, we are prepared to conduct a thorough investigation and gather supportive evidence to help build a strong case on your behalf.
Our consultations are free of charge and confidential. 1 (855) 722-2552.
What Forms of Compensation Can I Receive?
The forms of compensation you may be eligible to receive will depend on your particular situation. For most victims of defective drugs, the courts may award compensation to help cover the cost of medical bills from treating drug side effects. You may also be able to obtain compensation for the emotional damages you have experienced from taking the drug.
Damages from a defective drug claim may include:
- Costs associated with emergency services and hospitalization
- Future medical treatment required to make a recovery
- Mental health services to combat the drug’s neurological side effects
- Loss of wages and/or benefits from being unable to function at work
- Travel expenses to and from medical appointments
- Pain and suffering endured on a physical and mental level
To help determine the value of your damages, our lawyers will need to look at your medical records, doctor’s notes and statements from medical experts, among other factors.
History of Singulair
Singulair is a popularly-prescribed medication used to treat allergies and prevent wheezing and shortness of breath due to asthma attacks. The drug is manufactured by Merck & Co. and was approved for use by the Food and Drug Administration (FDA) in 1998 to help provide relief for asthma and allergy sufferers.
The medication works by blocking the effects of chemicals in your body known as leukotrienes that cause swelling in the lungs and muscles around your airways to narrow and tighten. During an asthma attack or allergic reaction, there are more leukotrienes circulating in the body. Singulair keeps them from causing inflammation that may cause or worsen asthma and allergies.
Singulair was specifically approved to prevent asthma attacks in adults and children older than 12 years old and asthma symptoms that can happen after exercise as well as treat seasonal allergies in adults and children older than 2 years old and symptoms of year-round allergies in adults and children older than 6 months.
Side Effects Associated With Singulair
Since taking Singulair, many people have suffered from new or worsening mental problems. Unusual changes in mood or behavior have been reported, such as:
- Anger, aggression and feeling restless or irritable
- Anxiety and depression
- Confusion, and problems with memory or attention
- Compulsive or repetitive behaviors
- Hallucinations, trouble sleeping and nightmares
- Suicidal thoughts or actions
A study published in the medical journal Pharmacology Research & Perspectives found that both adults and children who took the medication frequently experienced neurological side effects. Depression was the most commonly-reported side effect for adults and children and aggression was the most commonly reported side effected for just children. Nightmares were also often reported by both adults and children.
Other Singulair side effects include upper respiratory infection, headache, stomach pain, diarrhea, fever or other flu symptoms, tremors or shakiness, and ear pain.
FDA’s Actions Against the Drug
The FDA began receiving adverse reaction reports for Singulair in 2008, mainly for depression, aggression, irritability, nightmares, insomnia and suicide attempts. The agency updated the warning label to include a precaution against neuropsychiatric events.
In 2014, Merck & Co. asked the FDA for approval to use Singulair as an over-the-counter medicine for allergies. Consumer watchdog group Public Citizen successfully argued to the FDA Advisory Committee that the drug was too dangerous to be sold over the counter because the benefits of Singulair were minimal and the medication posed a potentially greater risk of side effects than other similar medications on the market.
The FDA banned the proposed sales and has since issued a boxed warning, the agency’s strongest warning, to help strengthen the existing warning about the risk of neuropsychiatric events associated with the drug.
Singulair Lawsuits Being Filed
Singulair lawsuits are currently being filed against drug manufacturer Merck & Co. for the serious mental health issues associated with taking the medication. The FDA has stated that many health care providers and patients are not fully aware of the risks involved. There is also no direct evidence to suggest that Singulair is more effective or just as effective as existing FDA-approved medications for asthma-related symptoms.
If you have a viable case, there is only so much time to bring a lawsuit. Not filing before the deadline expires will likely result in a court dismissal. That is why we recommend consulting with a lawyer from our firm today.
