Overview
On February 26, 2025, the United States District Court for the Southern District of Florida preliminarily approved a settlement in the case Philippe Calderon, et al. v. Sixt Rent A Car, LLC, Case No. 0:19-cv-62408-AHS, for consumer protection claims related to Sixt’s billing and credit reporting practices.
The lawsuit alleged that Sixt Rent A Car improperly charged customers vehicle damage related charges and, in some instances, reported those charges to credit agencies without sufficient investigation or notice, potentially harming consumers’ credit profiles. Plaintiffs claimed these practices were a breach of the rental agreement between Sixt and its customers and violated consumer protection laws.
Under the terms of the settlement, eligible Class Members may receive a cash payment and/or credit reporting relief upon submission of a valid claim. In exchange, Class Members agree not to pursue separate / individual lawsuits against Sixt for claims related to rental damage charges issued in connection with rentals that began on or before June 30, 2019, where the damage claim was first sent on or after January 1, 2014. The settlement does not constitute an admission of liability by Sixt, which denies all allegations. Class Members received notice by mail and were informed of their rights to file a claim, object to the settlement, or exclude themselves. A Final Fairness Hearing is scheduled for July 15, 2025, at which time the court will determine whether to grant final approval of the settlement as fair, reasonable, and adequate.
