Comedian Tracy Morgan is Suing Walmart After Fatal Truck Accident

In late June, comedian Tracy Morgan was involved in a truck accident that left him seriously injured and killed one of his friends. Morgan is now suing Walmart and alleging that their drivers negligence was the cause of the crash.

According to reports, Kevin Roper, the driver of the truck, was traveling 20 miles per hour over the speed limit and had been awake for more than 24 hours when the accident happened. According to the National Transportation Safety Board, Roper was almost at his drive limit when the collision occurred. Roper was on the road for about 13 ½ hours; federal rules permit truck drivers to work for up to 14 hours a day with a maximum of 11 hours behind the wheel.

The complaint also claims that the retail giant should have known that the drivers 700 mile commute from Georgia to Delaware was unreasonable and that the driver fell asleep at the wheel.

Along with Morgan, Ardley Fuqua and Jeffrey and Krista Millea, who were also injured during the crash are named as plaintiffs. The group is seeking compensatory and punitive damages.

Roper has pleaded not guilty to death by auto and assault by auto charges. A criminal complaint accuses of him of not sleeping for more than 24 hours before the accident, which is a violation of New Jersey law.
